Carr directs and owns Payroll Solution Services Ltd, which was put into liquidation on the petition of the Inland Revenue Department on 2 September 2011 by the High Court of Auckland pursuant to s. 241(2)(c) of the Companies Act 1993, as well as about 30 other NZ companies. As at liquidation, Carr has advised the liquidators that Payroll Solution Services “held no realisable assets” It “provided services exclusively to companies related to the director” and “ceased to trade in April 2011″).

Ray Smith was Production Manager for the hardcore porn film directed by Steve Crow entitled “RIPE” – featuring 22-year old “Nikki” (not her real name), a three-and-a-half pregnant “wannabe porn star”. The making of this video was dealt with in graphic detail on the 43 minute TV documentary “Naked Ambition” (recorded on 30 January 2003 and screened on TVNZ Channel One in May 2003); produced by Creme Media (now owned by Greenstone Pictures, Auckland).

It featured Steve Crow – referred to as “Porn King” and owner at that time of Vixen Direct – a hardcore porn distribution company. It included several scenes with Raymond Simpson together with Steve Crow involved in the filming of the pregnant “Nikki” having sex with two men – co-stars “William a “stripper” aged 24 years and “Andy” a self-declared “exhibitionist” and printer by occupation aged 39 years. Both men were recruited by Crow to take part in his film project. The programme noted that both co-stars were filmed having sex a number of times with ”Nikki” over several days, commencing 10 minutes after meeting her “co-stars”.

There was considerable controversy in 2002 when Crow’s plan to use public hospital facilities to film “Nikki” giving birth – in order to include the footage in his porn film, became public knowledge via the media. Critics were incensed by the intended exploitation of the soon-to-be-born child who they claimed would forever be dubbed “the porn baby”. Crow argued that “Nikki” had a right to have the birth filmed and have it included in the film featuring her. It was all about “freedom of expression” he argued.

As soon as the Society for Promotion of Community Standards Inc. learnt of Crow’s plans, its secretary wrote on behalf of the executive to the Chairperson of the Waikato Hospital Board, expressing concern over the moral and spiritual welfare oNikki’s child. The chairperson, soon afterwards, wrote to “Nikki” banning the filming of her labour and birth in its delivery suite for “unlawful purposes”. Crow was cery angry over the Board’s banning order.

Then the Society wrote to the Minister of Heath. Hon. Annette King, expressing concern over the moral and spiritual welfare of Nikki’s baby and pointing out that the exploitation of the baby’s birth to make porn, was being done for pecuniary gain by “Porn King” Steve Crow.

Crow stated on the Naked Ambition documentary that there is an “insatiable demand” for hardcore porn and that in Europe porn featuring pregnant women having sex was “popular” – referred to in media as “pregnancy fetish porn flicks”).

About an hour after receiving the Society’s letter, the Minister made a decision and issued a Ministerial Order blocking Steve Crow (nd his production manager Ray Smith) from using any public hospital facility in New Zealand to film ”Nikki” giving birth to her child – for use in a porn film.

Child, Youth and Family Services made application to the the High Court for an order banning Crow from filming the birth of Nikki’s baby for the purposes of using this footage in a porn film.

In October 2002 a High Court Judge – Justice Paul Heath- issued an order banning Vixen Direct owner Steve Crow from using footage of Nikki’s baby in his porn film

In his 45-page ruling Justice Heath wrote:

“I find myself in total agreement with the chief social worker’s conclusion that Nikki’s desire to be a ‘star’ has, in fact, over-ridden her judgment about what is in the best interests of the unborn child.”

He allowed the recording of the birth, but only if an assurance was given the footage would not be used in the film. He adjourned the case until 18 December 2002 to “ascertain what steps have been taken since the making of these orders.”

He said if undertakings were filed and deliberately breached he would consider it “a very serious breach of court for which likely punishment would be imprisonment.”

References

King seeks advice over birth ‘porn’

14 October 2002 NZ Herald

http://www.nzherald.co.nz/nz/news/article.cfm?c_id=1&objectid=2999028

Child-sex offenders in spotlight under National Party’s policies

Child Sex Crimes

Crime

Sexual Dysfunction

Child-sex offenders in spotlight as National focuses on law and order A SECOND-TERM National government will keep high-risk sex offenders behind bars indefinitely and may double the penalty for child-porn offences. He is serving four months’ home detention in New Plymouth for having objectionable images.

Hubbard pleaded guilty and was sentenced in July, after a police raid on his home in August 2010.

Kindergarten chairwoman Claire Hunn said police spoke to teachers on Thursday night about the man.

“Our gateway and our playground is exactly opposite this house. We will be checking with the police to see if there’s any action we can take because we do not want him living there.”

The kindergarten was also sending a notice to parents to stop any “panic”, she said.

Heather Mackie, Community Probation Services regional manager, said Hubbard would complete his sentence on December 10. programme in Christchurch Men’s Prison.

After his guilty pleas, the Crown decided not to seek preventive detention but it has been rethinking that decision after access was barred to reports on his treatment at the programme. Without those reports, the Crown faced a difficult assessment of any future risk to the community that the offender might pose.

In court today, the offender agreed to allow access by the Crown and his defence counsel to reports prepared on his treatment after the crown prosecutor sought a direction on the matter from Christchurch District Court Judge David Saunders.

The offender has a history of offending stretching back 20 years and the latest offences for which he now faces sentencing were committed from the 1990s to 2005 in Timaru.

He is seen as having a deeply entrenched sexual attraction to children, and is assessed as a high-risk pornography offender.

He is serving a two-year four-month term imposed in May last year for possession of objectionable material including images of bestiality and child pornography.

For more see: http://www.stuff.co.nz/national/crime/5862862/Paedophile-may-remain-a-risk

Story by David Clarkson, Dominion Post, 27 October 2011.

Registered charity challenges Court of Appeal’s child porn ruling

Child Sex Crimes

Crime

Porn Link to Rape

Pornography

Sexual Dysfunction

child rape

child rape victims

Court of Appeal

Denise Ritchie

name suppression

objectionable material

registered charity

Stop Demand Foundation

Stop Demand Foundation, a registered charity (CC 30599) with the Charities Commission, has attacked a Court of Appeal decision granting name suppression to a 50-year old Manawatu man found guilty of possessing images of child rape. The charity’s founder, Denise Ritchie, who was interviewed on TV One’s Breakfast programme about the matter this morning, says the Court’s decision is a blow to child rape victims in New Zealand and to lobby groups like hers around the world fighting sexual violence against children.

The Manawatu man, who admitted 21 charges of possessing objectionable material, was sentenced to six months home detention and fined $5250 at the end of last year.

In a decision only made public yesterday, the Court of Appeal ruled that his name should be kept completely secret to protect his family members.

Ms Ritchie, who has read and studied the decision, pointed out on TV One’s Breakfast programme that the convicted man has not lived with or had close association with any of the “family members” whose reputations and privacy the Court of Appeal Judges have sought to protect. She argues that granting name suppression to the offender merely to protect the reputation of these people sets a dangerous precedent.

Ms Ritchie also argues that the punishment imposed by the Court of Appeal was not commensurate with the gravity of the crime committed – and failed to take full account the fact that (1) the offender has been assessed as still posing a “low to medium risk of reoffending” and (2) the anti-child porn law allows for a prison sentence of up to five years to be imposed at sentencing.

The 100 pictures, videos and text files on the offender’s computer showed children as young as 18 months involved in sexual acts, including rape.

The judgement stated that publishing the guilty man’s name would lead to “incalculable hurt” to his family.

Ms Ritchie implied when interviewed on TV One, that this was on account of the positions held in the community by the offender’s family members. She claimed that if the New Zealand public was informed who they were and the positions they held, then there would be a public outcry over the name suppression order.

Ms Richie says that the name suppression order and “paltry” sentence constituted a big blow for child rape victims and it went against international efforts to crack down harder on such offenders.

The Manawatu man was found with 900 pages of text describing bestiality, incest and other sexual violations on children. The images, which depicted violent sex acts including pack rape on children, some of whom were bound and gagged while being raped by men, were downloaded off the internet over two and a half years.

“It seems the Court of Appeal had more regard for this sex offender and his family than the countless numbers of child rape victims and theitr families.

“These victims will be identifiable. They will live the rest of their lives without anonymity…”

Naming offenders would increase their future accountability to others.

It would also allow parents to protect their child from this offender should he be in contact with their kids.

Sources:

The Dominion Post, Thursday July 21, 2011, p. NZTDT 2011/7).

The Teachers Disciplinary Tribunal ruled that the defendent, aged 29, must meet the CAC’s actual and reasonable cost associated with the disciplinary proceeding and pay half the Tribunal’s costs.

“Teachers have a special status as leaders and should be respected – especially by our children,” says Bob McCoskrie, National Director of Family First NZ.

“Modeling and selling naked photos to a pornographic magazine doesn’t meet that standard. Associating the photos with her profession of teaching children is also unacceptable.

“These sexually explicit photos of the teacher have been published and are now in the public domain. The combined role of porn star and primary school teacher simply doesn’t fit for many families. (SPCS) from Herald on Sunday reporter Andre Hueber on Friday April 29, 2011 at 10.38 AM regarding LA Zombie, a film we were told was that was prevented from being screened at the Melbourne International Film Festival in July 2010. The Festival organisers had proposed to screen it, but the necessary ‘exemption’ for screening an unclassified film was not granted in that instance (pers. comm. Paul Tenison, Acting Applications Manager, Classification Branch, Australian Attorney General’s Department).

Hi SPCS

I’m writing a story about a gay porn zombie film called LA Zombie showing at Out Takes film festival in Auckland and Wellington in June [2011]. It was censored by the Australian Film Classification Board last year. They advised organisers of the Melbourne International Film Festival that the film couldn’t be shown as it was likely to be refused classification.

New Zealand’s Office of Film and Literature Classification has allowed the film to be shown here and classified it R18. A warning that the movie contains “violence, sex scenes and content that may disturb” is attached.

I understand the movie contains full frontal nude scenes, zombies with prosthetic cucumber penises, wound penetraion and implied sex with corpses.

The plot is described by Wikipedia as follows:

“A homeless schizophrenic thinks he’s an alien zombie sent to earth. Roaming the streets of Los Angeles in search of dead bodies, he tries to bring the dead back to life by engaging in homosexual sex.”

I’d like to know the Society’s thoughts on this and whether it plans to protest or complain.

Please get back to me as soon as possible ….

Kind regards

Andre Huester: Reporter

Herald on Sunday

__________________

Email Reply from John Mills, President SPCS

Thanks for the enquiry seeking comment.

For the legal and technical reasons why SPCS is appealing [to the Film and Literature Board of Review] against this Office of Film and Literature Classification’s decision [re LA Zombie], please consult with our Executive Director….

I [John Mills] am disappointed to learn that this film is being promoted by the [New Zealand] gay community, if indeed that is the case.

The gay community has gained widespread acceptability of their lifestyle within society during the last 20 or so years. I have come to accept and be supportive of this as a reality of the society we share. However, having said that, it is unfortunate that they allow themselves to be represented by what I think must be a radical minority who are seeking to promote this type of [film] material which has to be attempting to set a new low, pushing way beyond the boundaries of reasonablenes.

This film needs to be judged as not [as a valid form of] “freedom of expression” but injurious to the public good. For the sake of political correctness New Zealanders have become pressured into agreeing that anything goes, just as long as it does not hurt others. If we had not lost our senses of what will be harmful, we would not even need to be having the discussion [over this film].

I think we ought to be working together with the gay communitty to keep this material [that is injurious to the public good] out of New Zealand.

John Mills

__________

?COPY of Email sent to Andre Hueber from SPCS

Email from Department of Internal Affairs to SPCS.

Friday April 29, 2011 at 2.34 PM

[To SPCS]

“On behalf of Julie Wall, Senior Business Advisor, Business Services, Ministerial and Secretarial Services, Department of Internal Affairs, this is to confirm receipt of your completed application for a review by the Film and Literature Board of Review ……[received] today 29 April.”

Kind regards

Robyn Brooke

Executive Assistant to General Manager

Ministerial and Secretarial Services

The Department of Internal Affairs Te Tari Taiwhenua

Bowen House, Wellington

www.dia.govt.nz

________________

References

Banned Horror Film to Screen [in New Zealand]

by Andre Hueber 1 May 2011. The findings also show people with appetites for online sex, prostitution, sex that puts you at risk of harm, degrading sex, or public indecency tend to have commitment issues.

The first New Zealand study of “out-of-control sexual behaviours” and their impact on relationships has been completed by Massey psychology student Karen Faisandier as part of her honours degree.

Of the 621 participants in the anonymous online survey, two-thirds were assessed as having out-of-control sexual behaviour. There people were more likely to be anxious about closeness and find relationships threatening.

By contrast, most of the other respondents perceived relationships as safe, partners as trustworthy and intimacy as desirable.

Study shows sex addicts turned off by intimacy. The Dominon Post, p. A11, December 18, 20100

[Note: The SPCS has as one of its objects: "To focus atention on the harmful nature and consequences of sexual promiscuity, ... pornograhy.."].

Ms Faisandier said women with out-of-control sexual behaviours were more likely to be turned off by intimacy in a relationship than men. “But perhaps it just indicates … women will acknowledge and mention these anxieties, whereas men just don’t.”

Clinical psychologist and sex therapist Robyn Salisbury said it wasn’t uncommon for people with sex addictions to shum the intimaby they got at home, in favour of finding it elsewhere. “People who present with that sort of problem are no longer enjoying the sex. I’m sure Tiger Woods would say that, at the beginning, he had a great time but it actually would have got a bit ho-hum.”

Participants were also asked about alcohol and drug use, as well as their moods, to see if any links could be drawn. Depression was more prevalent in the minority group – a trend found only in New Zealand so far.
